1. Introduction These Terms and Conditions (“Terms”) govern your access to and use of the Designers Cove website (the “Site”), including any content, functionality, and services offered on or through the Site. The Site is operated by Designers Cove (“Company,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not access or use the Site.

Designers Cove are Designers and Craftsmen of upholstery and window treatments. We provide full service, sales and installations. We re-upholster antiques, mid-century modern, all periods and all types including boat interiors. We also custom design and build upholstered furniture, cornices, ottomans, benches, built-in seating and headboards. We sell fabrics and supplies. Designers Cove is the Costco preferred local dealer for all types of window treatments. We deal with many major and unique brands. Our services and products include fabrics, furniture, shutters, blinds, shades, drapes, hardware, accessories, design consulting services, Window Shades, Window Coverings, Upholstery Fabric, Custom Curtains, Boat Covers, Boat Upholstery, Drapery and Curtain Fabrics, Upholstery Supplies, and Furniture Frames.

2. Use of the Site You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, local, or international law;
  • Transmit any viruses, malware, or harmful code;
  • Attempt to gain unauthorized access to any part of the Site;
  • Use the Site for any commercial purpose without our prior written consent (except to inquire about or purchase our products/services).

3. Products, Services and Custom Orders All descriptions, images, and pricing on the Site are for illustrative purposes only and are subject to change without notice. Many of our products are custom-made to your specifications (including re-upholstery, custom furniture, window treatments, boat interiors, etc.).

  • Custom orders may require a non-refundable deposit.
  • Lead times vary and will be confirmed at the time of order.
  • We reserve the right to refuse or cancel any order at our sole discretion.

4. Ordering, Payment and Installation Orders may be placed via the Site (inquiry forms), by phone, email, or in our showroom. Payment terms will be provided at the time of order. We accept major credit cards and other payment methods as indicated. Full payment or final balance is due prior to delivery or installation unless otherwise agreed.

Installation services are available for window treatments, custom furniture, and boat upholstery. On-site measurements and site conditions are the customer’s responsibility to verify before fabrication.

5. Shipping, Delivery and Risk of Loss Shipping and delivery charges are calculated at checkout or quoted separately. Risk of loss passes to you upon delivery to the carrier. We are not responsible for delays caused by carriers or third-party installers.

6. Returns, Refunds and Cancellations Because most of our products are custom-made, returns, exchanges, or refunds are generally not accepted except in cases of our manufacturing defect or incorrect item shipped. Fabric samples and clearance items are final sale. Any approved return must be in original condition and may incur restocking or shipping fees. Cancellations after production has begun may result in forfeiture of the deposit.

7. Intellectual Property All content on the Site (text, images, logos, designs, fabric samples, etc.) is the property of Designers Cove or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Disclaimers The Site and all content are provided “as is” without warranties of any kind. We do not warrant that the Site will be error-free or uninterrupted. All warranties regarding our products (except as expressly stated in a separate written warranty) are disclaimed to the fullest extent permitted by law.

9. Limitation of Liability To the fullest extent permitted by law, Designers Cove shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or our products/services. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

10. Indemnification You agree to indemnify and hold Designers Cove harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Site or our products.

11. Governing Law and Dispute Resolution These Terms shall be governed by the laws of the State of Michigan. Any disputes shall be resolved exclusively in the state or federal courts located in Washtenaw County, Michigan..

12. Changes to the Terms We may update these Terms from time to time. We will notify you by posting the new Terms on the Site with an updated “Last Updated” date. Your continued use of the Site after such changes constitutes acceptance of the new Terms.
